අද ඇරඹෙන විවාදය  


අද ඇරඹෙන විවාදය



ඊනියා ව්‍යවස්ථා මණ්ඩලය විසින් පත් කෙරුණු මෙහෙයුම් කමිටුවේ අතුරු වාර්තාව අද සිට දින තුනක් විවාද කිරීමට නියමිතයි. මේ විවාදය පැවැත්වෙන්නේ ඇමරිකානු ඔරුමත්තුනාඩු යුද්ධ නැව් කිහිපයක් කොළඹ වරායේ තිබෙන අතර. ඒ සිද්ධි දෙක සමගාමී වීම අහම්බයක් වන්නත් පුළුවන්, සැලසුම් කරන ලද්දක් වෙන්නත් පුළුවන්. රනිල් වික්‍රමසිංහ හිතන් හිටිය ද දන්නෙ නැහැ ඊනියා ව්‍යවස්ථා මණ්ඩලයේ ඡන්දයෙන් පමණක් නව ව්‍යවස්ථාව සම්මත කර ගැනීමට. එහි දී රටේ විරුද්ධත්වයක් ඇති වුණොත් විදේශවලින් යුද්ධාධාර ඉල්ලීමට. එය හිතළුවක් පමණක් වුවත් රනිල් වැඩ කරන ආකාරයට හා බටහිරයන්ගේ හා ඉන්දියාවේ අවශ්‍යතා අනුව නව ව්‍යවස්ථාවක් කෙසේ නමුත් සම්පාදනය කිරීම අද ප්‍රධාන කාර්යය වෙලා.

ඇතැම් ජාතිකවාදීන් යැයි කියා ගන්නා අය උපදෙස් ගන්නේ ජාත්‍යන්තරවාදීන්ගෙන් බව පැහැදිලියි. අද අප ඕනෑම අවස්ථාවකට මුහුණ දීමට සූදානම් ව සිටිය යුතුයි. රනිල්ගේ ප්‍රජාතන්ත්‍රවාතය යටතේ කුමක් සිදුවේ ද යන්න කල් තබා මුළුමනින් ම  කීම තරමක් අපහසුයි. එහෙත් එය යම් තරමකට පුරෝකථනය කරන්න පුළුවන්. අප අතර සිටින ජාතිකවාදීන් යැයි කියා ගන්නවුන්ගෙන් අප පරෙස්සම් විය යුතුයි. නිතර දෙවේලේ රූපවාහිනියෙන් වාචාල කතා කී පමණින් කිසිවකු ජාතිකවාදියකුවත් බුද්ධිමතකුවත් වන්නේ නැහැ.

නව ව්‍යවස්ථාව ප්‍රතික්‍ෂප කරමු



අද රටේ මහත් උනන්දුවක් ඇති වී තිබෙන්නේ ආණ්ඩුක්‍රම ව්‍යවස්ථාවක් සම්පාදනය කිරීම ගැනයි. විය යුතු පරිදි ම අනෙක් ප්‍රශ්න යටපත් කරගෙන ව්‍යවස්ථා සම්පාදනය කිරීම පෙරට ඇවිත්. මහා සංඝ රත්නය තමන්වහන්සේගේ නිකාය, පාර්ශ්වය ආදියෙහි කාරක සභා යොදා ගනිමින් නව ව්‍යවස්ථාව ප්‍රතික්‍ෂෙප කරනවා. උන්වහන්සේ පොදුවේ ගතහොත් ප්‍රකාශ කරන්නේ නව ව්‍යව්ථාවක් සම්පාදනය කිරීමට ආණ්ඩුවට ජනවරමක් නැති බවත් මේ ආණ්ඩුක්‍රම ව්‍යවස්ථාවක් සම්පාදනය කිරීමට අවස්ථාවක් නොවන බවත්. උන්වහන්සේ පොදුවේ නැතත් මැතිවරණ නීතිය සංශෝධනය කිරීමට එකඟ වන බව  ප්‍රකාශ කර සිටිනවා.

නව ව්‍යවස්ථාවක් ඕන කරන්නේ බටහිරයන්ට ඉන්දියානුවන්ට ඔවුන්ගේ ඔත්තු සේවාවන්ට ඔවුන්ගෙන් යැපෙන දෙමළ ජාතිවාදීන්ට හා පඬියන්ට බව අප ඊයේත් සඳහන් කළා. මේ ව්‍යවස්ථාව හදිසියේ ගෙන එන්නක් නො වෙයි. බටහිරයන් හා ඉන්දියාව මේ ආණ්ඩුව පත් කර  ගත්තේ ම ව්‍යවස්ථාව සම්පාදනය කිරීමට. නව ව්‍යවස්ථාව දහතුන රැකීමට හා දහතුන තවත් ඉදිරියට ගෙන යෑමට. ඒකාබද්ධ විපක්‍ෂයට උපදෙස් දෙන ඇතැම් පඬියන් කියනවා තමන් දහතුනෙන් එහාට දශමයක්වත් යෑමට ඉඩ නො දෙන බව. එය හුදු වාගාඩම්බරයක් පමණයි. අප රැවටීමක් පමණයි. ආණ්ඩුවත් කියන්න ඉඩ තියෙනවා තමන් දහතුන නියමාකාරයෙන් ක්‍රියාත්මක කිරීම හැර වෙනත් දෙයක් කරන්නෙ නැහැ කියලා.

මේ කාට ඕන නව ව්‍යවස්ථාවක් ද?



මේ අවස්ථාවේ නව ව්‍යවස්ථාවක් සම්පාදනය කිරීමට ඇති අවශ්‍යතාව කුමක් ද? ව්‍යවස්ථාවක් සම්පාදනය කිරීමට පෙර ඇසිය යුතු පළමු ප්‍රශ්නය එයයි. පසුගිය ජනාධිපතිවරණයට ඉදිරිපත් වූ ප්‍රධාන අපේක්‍ෂකයන්ගෙන් එක් අයකු වූ මහින්ද රාජපක්‍ෂට ව්‍යවස්ථාවක් සම්පාදනය කිරීමේ අවශ්‍යතාවක තිබුණේ නැහැ. අනෙක් අපේක්‍ෂකයා වූ මෛත්‍රිපාල ජනමත විචාරණයකට තුඩු නොදෙන ආකාරයකට ව්‍යවස්ථාව සංශෝධනය කිරීමට පොරොන්දු වුණා. එයින් කියැවෙන්නේ ජනාධිපතිවරණයේ  දී නව ව්‍යවස්ථාවක් සම්පාදනය කිරීමට මෙරට ජනතාව වරමක් දී නොමැති බවයි.

විස්ස ගැන අද තරමක කතාවක් පවතිනවා. විසිවැනි සංශෝධනය පාර්ලිමේන්තුවට ගෙනාවේ පළාත් සභා ඡන්ද කල් දැමීමට. බොරු කයිවාරු කියෙව්වත් ආණ්ඩුව මැතිවරණවලට බයයි. පහුගිය අවුරුදු දෙකට ආණ්ඩුව එක මැතිවරණයක්වත් පවත්වලා නැහැ. පවත්වපු සමුපකාර ඡන්දවලින් එ ජා ප පරාදයි. මෛත්‍රිපාලගේ කල්ලියට ඇපත් නැහැ. මෛත්‍රිපාල ඒක නොදන්නවා නො වෙයි. මෛත්‍රිපාලත් රනිලුත් එකතු වෙලා අද කරන්නෙ මැතිවරණ කල් දාන එක. මෛත්‍රිපාල රනිලුත් එක්ක එකතු වෙලා ශ්‍රී ල නි පක්‍ෂ සම්මේලන පැවැත්තුවට වැඩක් නැහැ. මෛත්‍රිපාලගෙ වෛරය හා බය නිසා රට අගාධයට යනවා.

මේ ආණ්ඩුව අසමත් බව බොහෝ දෙනා දන්නවා. ආණ්ඩුව වැඩ බැරි ටාසන්ලාගෙන් පිරුණු එකක්.  ආණ්ඩුව මොන පුරසාරම් දෙඩුවත් එයට මුදල් නැහැ. ජාත්‍යන්තරය ජයගත් බව කීවත් ඔවුන්ගෙන් ලැබෙන ආධාරයක් නැහැ. ජී එස් පී + යනු ආණ්ඩුවේ ඇත්තන්ගේ ම බසින් නම් ළුෑණු බිකක් පමණයි. එයින් පරිප්පු කොපමණ ප්‍රමාණයක් ගත හැකි ද කියා ඉන්දියාවෙන් ඇසිය යුතුයි. ආණ්ඩුව පත් කර ගැනීමෙන් ජනතාව නම් හොඳ පරිප්පුවක් දිනපතා කනවා.

දහතුනෙන් එහාට යෑමට දෙන්නේ නැහැ කියන එක අද ඇතැමුන්ගේ සටන් පාඨයක් වෙලා. නව ව්‍යවස්ථාවක් එපා යනුවෙන් මහානායක ස්වාමීන් වහන්සේ ප්‍රකාශ කර ඇත්තේ උන්වහන්සේ දහතුන්වැනි ව්‍යවස්ථා සංශෝධනය අනුමත කරන නිසා නො වෙයි. සිංහල බෞද්ධයන්ගෙන් අති විශාල පිරිසක් දහතුන අනුමත කරන්නේ නැහැ. ඉන්දු ලංකා ගිවිසුමට විරුද්ධ වූ බොහෝ දෙනා ද දහතුන ප්‍රතික්‍ෂෙප කරනවා. අද දහතුනට පක්‍ෂව කතාකරන්නන් සමහර දෙනකු තමන් ජාතික ව්‍යාපාරයෙහි ද ඉන්න බව පෙන්වීමට උත්සාහ දරනවා. දහතුනට පක්‍ෂ අය එදා ඉන්දු ලංකා ගිවිසුමටත් පක්‍ෂ වුණා. වර්ධරාජ පෙරුමාල්ගේ ආණ්ඩුවේ ඇමතිකම් දරා හෝ නොදරා හෝ රනිල් නිසා යහපාලනයේ තැනක් ගැනීමට බැරුව ජාතික ව්‍යාපරයෙහි පතාක යෝධයන් බවට පත් වී ඇති පිරිස් ද දහතුන වෙනුවෙන් කතා කරන බව පේනවා.  ජාතික ව්‍යාපාරයෙහි ඇතැමුනට මොවුන් පෙනෙන්නේ යෝධයන් ලෙසයි. තමන් අඟුටුමිට්ටන් වූ පමණින් ජාති ද්‍රෝහීන් ජාතික ව්‍යාපාරයෙහි යෝධයන් බවට පත් කිරීම හෙළා දැකිය යුතු වෙනවා.

ව්‍යවස්ථා විරෝධී ව්‍යාපාරය



නව ව්‍යවස්ථාවට විරුද්ධත්වය පෑම යනු කුමක් ද? නව ව්‍යවස්ථාවක් සම්පාදනය කිරීම පරාජය කිරීම එහි එක් අංගයක් පමණකි. එහෙත් එය පමණක් ප්‍රමාණවත් නො වේ. දැනට අප ජීවත් වන්නේ සන්ධීය හෙවත් ෆෙඩරල් රාජ්‍යයක බව පැහැදිලියි.  දහතුන් වැනි ව්‍යවස්ථා සංශෝධනයෙන් කෙරුණේ සන්ධීය රාජ්‍යයක් ඇති කිරීමයි. ඒ පිළිබඳ ව ශ්‍රෙෂ්ඨාධිකරණයෙහි විනිසුරුවන් හතර දෙනකු එක හෙළා ප්‍රකාශ කෙළේ එකී සංශෝධනයෙන් සන්ධීය රාජ්‍යයක් බිහිවන බවයි. විනිසුරුවන් හතර දෙනකු තීරණය කෙළේ එයින් සන්ධීය රාජ්‍යයක් බිහි නොවන බවයි. එක් විනිසුරුවකු පාරින්ද රණසිංහ ප්‍රකාශ කෙළේ 154 G(2) (b), 154 G(3) (b) ව්‍යවස්ථා ආණ්ඩුක්‍රම   ව්‍යවස්ථාවට පටහැණි බවයි. ඉන් ජනතා පරමාධිපත්‍යය දිය වී යන බවයි.

ඊයේ පළ වූ ලිපිය මා සිතූ පරිදි ම වැඩි දෙනකුගේ අවධානයට යොමු වී නැහැ. සමහර විට එය ඊනියා නැගලා යන මාතෘකාවක් නොවන්න පුළුවන්. ඒ වුනත් මා පොරොන්දු වූ පරිදි එහි ඉතිරි කොටස මෙහි පළ කරනවා. මේ කතාවත් බොහෝ දෙනාට ප්‍රියජනක නොවිය හැකියි. විශේෂයෙන් ම සෙංකෝලය උස්සන් දුවන දේශපාලනඥයන්ට හා ඒ අය අගය කරන්නන්ට මෙහි දැක්වෙන අදහස් කාලීන නොවන්න පුළුවන්. විස්ස මගින් ආණ්ඩුව පෙරලන්නට උත්සාහ කරන අයට ද මේ ප්‍රතිගාමී අදහස් විය හැකියි.

මා සහ ජාතික චින්තන මතධාරීන්



ජාතික චින්තන මතවාදයක සිටින්නේ යැයි කියන අය සහ මා අතර පරස්පර පැන නැගී තිබෙනවා. රටේ ඉතා විශාල පිරිසකට මා කියන කිසිම දෙයක් තේරෙන්නේ නැහැ. සමහර විට මා වැදගත් කිසිම දෙයක් කියා නැතිවා වන්නටත් පුළුවන්. බොහෝ දෙනා අද වස විස නැති ආහාර ගැන කතා කරනවා. කෘෂි රසායනවලට විරුද්ධ වෙනවා. වස විස නැති ආහාර ගැන මෙරට කතාබහ කරන්න පටන්ගෙන බොහෝ කල්. එමෙන් ම මෙරට සාම්ප්‍රදායික පොහොර යෙදීම ගැනත් කලක සිට කතා වුණා. වකුගඩු රෝගය ගැනත් රජරට වාසය කරන ඇතැමුන් මෙන් ම බටහිර වෛද්‍යවරුන් කිහිප දෙනකුත් සොයා බලා තිබුණා. එහෙත් මේ එකකටවත් ජනමාධ්‍යයෙහි ප්‍රසිද්ධියක් දී තිබුණේ නැහැ.

Indo Lanka Accord and the Provincial Councils - I

During the last few weeks in these columns we argued that the Indo Lanka Accord is now defunct due to the failure of India to fulfill its obligations under the accord. Also we have argued that the thirteenth amendment is not law of the country and that there is no barrier to abolish the provincial councils. If a referendum was held without submitting bills to the Parliament to determine the wish of the people there is no doubt whatsoever that the people would approve the termination of the provincial councils by a two third majority. What the government and the so called nationalist parties in the government should have done was to submit a bill to the cabinet of ministers under the Article 85 (1) of the constitution to abolish the thirteenth amendment. If the cabinet certified that the bill should be submitted to the people by a referendum then a referendum could have been held before the bill was presented to the Parliament. However, my view was rejected by the “nationalist organizations” who clearly have a different agenda.

The Article 85 (1) states: “The President shall submit to the People by Referendum every Bill or any provision in any Bill which the Cabinet of Ministers has certified as being intended to be submitted to the People by Referendum, or which the Supreme Court has determined as requiring the approval of the People at a Referendum if the number of votes cast in favour of such Bill amounts to not less than two-thirds of the whole number of Members (including those not present).”  The cabinet, even if some members are opposed to the abolition of the thirteenth amendment, could not have objected to this proposal to refer the bill to the people as it would have amounted to rejection of the legislative power of the sovereignty of the people which the latter exercised through the Parliament. The cabinet which after all is only a subset of the Parliament derives power from the people and cannot object to going to the source from which power generates. However, the government decided to curtail some of the Articles of the thirteenth amendment through the Parliament making use of  not only Article 82 on the amendment of the constitution but Articles 154 G (2) (b) and 154 G (3) (b) which are in any event not law of the country. The government should not invoke the “articles” 154 G (2) (b) and 154 G (3) (b) to amend any provisions of the thirteenth amendment not only because the so called articles are not law of the country but it goes against the article 82 (6) : “No provision in any law shall, or shall be deemed to, amend, repeal or replace the Constitution or any provision thereof, or be so interpreted or construed, unless enacted in accordance with the requirements of the preceding provi­sions of this Article.” Any amendment to the constitution, including the thirteenth amendment, has to be made invoking Article 82.  

The thirteenth amendment has to go sooner or later as it is not only a “solution” imposed on us by India to a non existing problem of the Tamils but forced on us through the back door by threats and “parippu” or “dhal” diplomacy. What we have is a problem of the English educated Vellalas who projected to the world with the approval of the English that their loss of privileges they enjoyed under the colonial rulers over not only the other Tamils but also the Sinhala people as a whole was a discrimination against the Tamils in general. It is unfortunate that even today many Sinhalas have not been able to grasp this phenomenon. We should not succumb to middle class morality of honouring so called international agreements. The only agreement in this regard is the Ando Lanka Accord which to say the least betrayed our sovereignty. We have argued along these lines since 1987 in “Divaina” and “Kalaya” that is not in publication now, but what is interesting is that the Accord does not define the provincial councils but refers to them as if they had been already established.  It is true that the President, the Ministers and some Public Servants are empowered to enter in agreements with other countries on behalf of the country. However the question is whether they could betray the sovereignty of the people in the process. In the case of the President the Constitution specifically states under the Article 33 (f) that he has the power “ to do all such acts and things, not being inconsistent with the provisions of the Constitution or written law as by international law, custom or usage he is required or authorized to do.” The Indo Lanka Accord is inconsistent with the provisions of the Constitution as it specifies what the Government of Sri Lanka has to do in connection with legislative powers.

However, in their desire to hide this aspect the Indian Brahmins have done a shoddy job and deliberately not defined a provincial council.  Sri Lanka had no provincial councils before the thirteenth amendment and the Accord should have defined what these monsters were. At least they could have said as they had done in paragraph 2.1 reproduced below that the Sri Lankan government “proposes” to establish provincial councils and described their powers and functions briefly. They did not do that but in paragraph 2.2 referred to hitherto non existing provincial councils.  

“2.2 During the period, which shall be considered an interim period (i.e. from the date of the elections to the Provincial Council, as specified in para 2.8 to the date of the referendum as specified in para 2.3), the Northern and Eastern Provinces as now constituted, will form one administrative unit, having one elected provincial council. Such a unit will have one Governor, one Chief Minister and one Board of Ministers.” I wonder what happened to the Nyaya Sastra of the Brahmins. Surely the Brahmins knew that Sri Lanka did not have any provincial councils and 2.2 and other paragraphs that refer to provincial councils are meaningless. In case one wonders what paragraph 2.8 is, it is reproduced below. 

“2.8 Elections to Provincial Councils will be held within the next three months, in any event before 31st December 1987. Indian observers will be invited for elections to the Provincial Council of the north and east.” Incidentally this is not something that the government of Sri Lanka “proposes” as in the paragraph 2.1 and it is a case where India has meddled with our sovereignty specifying dates for elections for non existing provincial councils. Further the Kautalyas had said that Indian observers would be invited which simply means that the elections would be held under the Brahminic eyes.

The all important paragraph 2.1 states: “2.1 Since the Government of Sri Lanka proposes to permit adjoining provinces to join to form one administrative unit and also by a Referendum to separate as may be permitted to the Northern and Eastern Provinces as outlined below:” The government of Sri Lanka had proposed it while the innocent Brahmin babies had listened to the representatives of the Sri Lankan government! Now where in the constitution of Republic of Sri Lanka it says that provinces are administrative units? The Provinces are not defined at all in the constitution whether as administrative units or not and the poor Kautalya must have turned in his grave if he was not cremated. The administrative units or districts are given in the first schedule of the constitution and the Indian Brahmins had clearly violated our constitution while J R Jayawardhene and his ministers had betrayed the country and the people. It is unfortunate that there was no Mahaushadha among the advisors to the President Jayawardhene to to do what the former did to the Kevattaya.    

The above is not the only betrayal by Jayawardhene and infringement of our sovereignty by the Brahmins. The paragraph 1.4 of the Indo Lanka Accord states: “ Also recognising that the Northern and the Eastern Provinces have been areas of historical habitation of Sri Lankan Tamil speaking peoples, who have at all times hitherto lived together in this territory with other ethnic groups:” This is a lie to say the least referring to part of the Ruhunu Rata as well. Here again what right has India got to demarcate a region of the country as a so called historical habitation of Sri Lankan Tamil speaking peoples?   (To be continued)

On the land issue



We move from the topic Western science, Astrology and Arsenic temporarily in order to discuss one of the important topics in current  politics. It is concerned with the power to distribute land as stated in the thirteenth amendment. The thirteenth amendment is not a solution to a problem in Sri Lanka but an act imposed on us by the Indians modeled on their state administration to solve a problem peculiar to India. India did not consider the history, the eksesath rajya we had before the Portuguese came to Sri Lanka, the culture or more importantly the demographic patterns and the powers that changed those patterns after 1506. In this article I will consider only the problem of land distribution though from 1987 through the APRC I have opposed the 13th amendment in general and land and police powers in particular. At the APRC when Dr. Tissa Witharana and many others wanted to submit an interim report to satisfy India stating that we agree to implement the 13th amendment in full, it was my objection that prevented them wording the report the way India wanted. I must place on record the dedication of Mr. Udaya Gammanpila of the JHU in opposing the Tissa Witharana move. 

It is a well known fact obtained from the Portuguese historians that when the Portuguese conquerors came to the island we had an eksesath rajya though they do not refer to such rajya. There was no way that the Portuguese could have understood the system we had, and the reference to kings and an emperor in Kotte demonstrates that the Portuguese historians looked at the eksesath rajya using the concepts they were used to. We never had emperors in this country and the Portuguese who did not know anything of the eksesath rajya referred to the king of Sri Lanka Eksesath Rajya as the emperor. Those who insist on looking at history from the Portuguese point of view will continue with an emperor and so called independent kingdoms in the island.

The first state intervention in changing the demographic pattern of the country took place during the period of King Senerath who settled the Muslims who were harassed by the Portuguese  in the present eastern province. It is regrettable that some Muslims have forgotten this and are now attempting to convert Kaththankudy into a Little Arab with date trees etc., as I witnessed during a recent tour in the eastern province. It should be emphasized that the Sinhala Buddhists have never had had any Little Kalingas or Bengals or Maharashtras or even Buddhagayas even if we believe in the Vijaya story. Let us all live in Sri Lanka without little this or that from foreign countries. When King Senerath settled the Muslims in the present eastern province it was populated with the Sinhalas and it was the rice bowl at least from the time of Prince Saddhatissa who cultivated Digamadulla. In any event the present eastern province was part of the Ruhunu Rata. It has to be mentioned that rata has been used by the Sinhala people not only to refer to the country but to parts of the country as well as exemplified by atadahas rata, dolosdahas rata etc. The present usage of uda rata and pahatha rata is following this tradition.              

The most crucial settlement was by the Dutch who brought Tamil Vellalas from present South India for their tobacco cultivation and settled them in the Jaffna peninsula. It is on record by Portuguese that the Sinhala people were the majority in Jaffna when they arrived. These Sinhala people have been Tamilized  in the process and have been made members of the so called low casts of the Jaffna Hindu society. It was after about 1750 that saw the beginning of the Dutch rule in Sri Lanka that changed critically the demographic patterns in Sri Lanka and needless to say that it happened with the auspices of the Dutch governor. It was state colonization and nothing else though there was no Dutch state as such in Sri Lanka. The maps that have been prepared by the Dutch after 1750 ( I can give the reference if anybody is prepared to help me to translate the records to Sinhala or English) give the Sinhala names of the villages and these would go a long way in establishing that it was after 1750 that the demographic patterns at least in the Jaffna peninsula have been changed drastically by the Dutch.

The present Tamil population in Jaffna consists of the descendants of the Tamil vellalas brought by the Dutch and those of Tamilized Sinhala people living in Jaffna before 1750 and also some Velakkaras who spoke Malayalam. This corroborates with the linguistic opinion that the  difference between Tamil spoken in Jaffna and that spoken in Tamil Nadu in general is not more than two hundred and fifty years, and that Jaffna Tamil has been influenced by Malayalam. With the occupation of the country by the English, by breaching the Sinhala English accord or what is known as the Kandyan convention by the gentlemanly English, instead of ruling the country according to the Sinhala tradition the rulers appointed a Muslim as the tax collector in certain areas. The Sinhala leaders having realized that they had been cheated by the English King (his representative the governor) rose against the colonialists in 1817 – 18 which was our first independence struggle in English occupied Sinhale. The English “respecting” the human rights of the Sinhalas to be reborn massacred the Sinhala population killing not only males above 15 years but even killing the cattle of the Sinhala people. The record of the English with respect to our independence struggle is most cruel to say the least, and during this Veask week we can only engage in “Maithree Bhavana” towards the governors such as Brownrigg, Torrington and their mothers.  

After the massacre the remaining Sinhala people were forced to leave the rice bowl, Uva Vellassa (vel lakshaya - hundred thousand paddy fields) and the cultivation of the land was thereafter in the hands of the Muslims. The present eastern province was almost devoid of any Sinhala people and to make matters worse the English settled Tamil labourers brought from present Tamil Nadu in these areas. The final importation of the Tamil labourers by the English was for their coffee and tea plantations in the “up country”.

What I want to emphasize is that before the Portuguese came to Sri Lanka the vast majority of the population from Nagadeepa to Devundara was Sinhala with pockets of Tamil speaking Muslims, or so called Moors who had come from South India. They were Tamil speaking Muslims whatever their ethnicity was. Any changes in the demographic patterns since 1506 have been due to state intervention. Except in the case of King Senerath all the other changes have been effected by colonial rulers. Even in the case of settlings of Muslims by the Sinhala king it was carried out as a result of Portuguese harassing the Muslims.

In all these instances it was the Sinhala people who have lost “their” land especially at the hands of the Dutch and the English. If there has been a historical injustice it is to the Sinhalas as a result of land “distribution”. The colonial discrimination has to be rectified and naturally it has to be done by the government. The so called historical habitats of the Tamils had been historical habitats of the Sinhala for more than two thousand years until colonial intervention. Those who oppose any land distribution by the government want to maintain the status quo due to colonial rulers and it is a case of maintaining the colonial injustices to the Sinhala people. Also  maintaining army camps as far as the security of the country is concerned is the prerogative of the government. Taking all these things into consideration distribution of land in the entire country should be in the hands of the government and legislation should be enacted not to leave these powers ( and police powers etc.)  with the Provincial Councils the baby of India, if the thirteenth amendment cannot be repealed just now due to some reason or other.
